What do I have to disclose when selling vacant land in South Carolina?
South Carolina does not have a mandatory vacant-land disclosure form like it does for residential property. That does not mean you can stay quiet. Buyers will find every disclosable item at title search, and surfacing them first beats fixing a deal that broke at closing.
Is there a required disclosure form for vacant land in South Carolina?
No. SC requires a Residential Property Condition Disclosure for improved residential property, but vacant land is exempt from that form. There is no equivalent state form for raw land. That said, common law fraud and misrepresentation still apply: if you actively conceal a known material defect, the buyer has legal recourse after closing.
What should I disclose voluntarily?
Six items, in priority order. (1) FEMA flood zone designation. (2) Jurisdictional wetlands percentage if you know it. (3) Recorded easements (utility, access, conservation, ingress-egress). (4) Road access type (paved, county-maintained dirt, private easement). (5) Any known title issues (heir property, unpaid back taxes, liens). (6) Past timber cuts or active timber leases. These are the items that come up at title search and inspection.
What happens if I do not disclose something a buyer finds later?
If the buyer discovers a material defect post-closing that you knew about, they can sue for damages or rescission. SC courts apply caveat emptor (buyer beware) more strongly to vacant land than to residential, but active concealment or affirmative misrepresentation crosses the line. Honest disclosure is cheaper than litigation.
